Terms and Conditions
These Terms and Conditions govern how Nutreal LLC ("Nutreal", "we", "us") provides personalized snack boxes, wellness boxes (including the Nutreal Wellness Box), and subscription services to individual consumers in Bulgaria. By browsing this website, placing an order, subscribing to our service, or making a purchase, you confirm that you have read, understood, and agree to these Terms. These Terms apply to consumers purchasing for personal use, not for business or commercial purposes.
1. About Nutreal and scope of these Terms
Nutreal LLC is a company registered in Bulgaria that provides personalized snack box subscriptions, wellness boxes (including one-time and subscription-based wellness products), and related services to individual consumers. These Terms apply to all purchases of personalized snack boxes, wellness boxes, subscriptions, and related products made through our website. 2. Eligibility and age requirements
You must be at least 18 years old to purchase personalized snack boxes or wellness boxes from Nutreal. By creating an order, you confirm that you are of legal age and that you are purchasing for personal, non-commercial use. If you are purchasing as a gift, you confirm that the recipient meets these requirements.
3. Orders, subscriptions, and personalized box generation
When you complete our personalization wizard, we generate a personalized snack box recommendation using AI based on your preferences (health goals, lifestyle, protein preferences, taste preferences, and dietary restrictions). This recommendation is stored as a draft until you complete your purchase. You can purchase a one-time personalized snack box or subscribe to receive such boxes on a recurring basis (weekly, bi-weekly, or monthly). For wellness boxes (including the Nutreal Wellness Box and any other pre-made wellness products), you can order directly from the relevant product page without completing the personalization wizard. Unless explicitly stated otherwise, the ordering, payment, delivery, cancellation, and refund rules in these Terms apply equally to wellness boxes. All prices are displayed in Bulgarian leva (BGN) and include applicable VAT. Prices shown include the official EUR to BGN exchange rate as required by Bulgarian law for compliance. When you create an order or subscribe, you will receive an order confirmation email. A contract is formed when we accept your order and process your payment through Shopify. The customer is obliged to pay the price that was current at the time of contract formation. In case of technical errors in the publication of the website, the Provider has the right to refuse fulfillment of the contract and is not liable for any compensation to the Customer, except to refund any amounts paid by the Customer, if any. We reserve the right to refuse or cancel orders at our discretion, including in cases of pricing errors, stock unavailability, or suspected fraud. If we cancel an order after payment, we will issue a full refund.
4. Pricing and payment
Prices are subject to change at any time, but changes will not affect orders that have already been confirmed and paid. For personalized snack boxes, subscription prices vary by frequency: one-time purchases are €24.99, monthly subscriptions receive a 15% discount, bi-weekly subscriptions receive a 20% discount, and weekly subscriptions receive a 25% discount. Prices and discounts for wellness boxes and other wellness products are shown on the relevant product pages and may differ from the personalized snack box pricing, but are always displayed together with their BGN equivalent for compliance with Bulgarian regulations. All payments must be made in advance through Shopify, our secure payment processor. We accept major credit and debit cards. Payment processing and subscription management are handled by Shopify, and we do not store your card details. Prices are displayed in EUR with BGN equivalent shown for compliance with Bulgarian regulations. BGN prices include VAT.
5. Delivery and shipping
We deliver personalized snack boxes and wellness boxes to addresses within Bulgaria. For subscriptions (whether for personalized snack boxes or wellness boxes, where available), deliveries are made according to your selected frequency (weekly, bi-weekly, or monthly). The first delivery is typically scheduled within 3-5 business days after order confirmation, unless you specify a different date. Delivery times are estimates and may vary. Risk in the products passes to you when they are delivered to the address you provided or to a person reasonably understood to be acting on your behalf. You are responsible for providing accurate delivery information. If incorrect or wrong address, person and/or contact phone is provided when submitting an order, Nutreal LLC is not bound by an obligation to fulfill delivery of the requested products. If delivery fails due to incorrect information, you may be charged for re-delivery.
6. Dietary needs, allergies, and product suitability
Personalized snack boxes are curated based on your preferences and dietary restrictions provided during the personalization process. Wellness boxes are curated around general wellness themes (for example, relaxation, beauty, energy and cycle comfort) and may include both food products and cosmetic or self-care products. We work with reputable producers and clearly label products. Our AI system attempts to exclude products that violate your stated restrictions for personalized snack boxes, but we cannot guarantee that items in any box are completely free from specific allergens or that they are suitable for every individual. You are responsible for checking product ingredients, cosmetic usage instructions, and allergen information on packaging. If you have severe allergies, specific dietary requirements, or sensitivities to cosmetic ingredients, please contact us before creating an order. We recommend reviewing all product labels upon receipt.
7. Website use
You agree not to misuse our website or attempt to gain unauthorized access, introduce malicious code, interfere with the normal operation of the service, or use automated means to harvest data. We may suspend or restrict access where necessary to protect the security, integrity, or availability of our services.
8. Intellectual property
All content on this website, including text, visuals, branding, and layout, are owned by or licensed to Nutreal and protected by applicable intellectual property laws. You receive no license or rights in this content other than what is strictly necessary to browse the website and make purchases.
9. Personal data and privacy
When you place orders or interact with Nutreal, we process personal data as described in our Privacy Policy. By using our services, you acknowledge that you have read our Privacy Policy and that we may process personal data as described there. You may exercise your GDPR rights using the contact details provided in our Privacy Policy.
10. Warranties and limitation of liability
We provide our products and services with reasonable care and skill but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we exclude all implied warranties. Nutreal will not be liable for indirect, consequential, or lost-profit damages. Our total aggregate liability for any claim will be limited to the total amount paid by you for the specific order giving rise to that claim, except where a higher liability cannot be excluded under applicable law.
11. Force majeure
Nutreal will not be liable for delays or failures to perform caused by circumstances beyond our reasonable control, including but not limited to: stock shortages, transport disruptions, natural disasters, severe weather conditions, pandemics, or other force majeure events.
12. Failed or refused deliveries
If delivery cannot be completed due to reasons attributable to you (e.g., no one available to receive, incorrect address, access issues), the delivery may be treated as completed for the purpose of risk transfer. We may offer re-delivery options, which may be subject to additional fees.
13. Right of withdrawal, returns, and refunds
Under Bulgarian Consumer Protection Act and EU Directive 2011/83/EU, you have the right to withdraw from a distance contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you acquire physical possession of the goods. However, due to the perishable nature of food products, the right of withdrawal does not apply to goods that are liable to deteriorate or expire rapidly (Article 16(m) of Directive 2011/83/EU). For subscription services, you may cancel your subscription at any time through your Shopify account or by contacting us. Cancellation will take effect at the end of the current billing period, and you will continue to receive deliveries until then. If you receive damaged, incorrect, or defective products, please contact us within 48 hours of delivery with photos and details. We will investigate and, where appropriate, provide a replacement, credit, or refund. 13.1 Refund processing If payment was made by bank card, refunds will be processed by arranging a reverse transaction to the card used for payment within 14 business days. We require and maintain that refunds be processed via reverse transaction to the card used for payment to avoid future transaction problems. 14. Subscription terms
Subscriptions automatically renew according to your selected frequency (weekly, bi-weekly, or monthly) until cancelled. You may cancel your subscription at any time through your Shopify account or by contacting us at contact@nutreal.bg. Cancellation will take effect at the end of the current billing period, meaning you will receive all boxes already paid for. We do not provide refunds for unused portions of a subscription period, except as required by law. You may change your subscription frequency or pause your subscription by contacting us. Changes may take effect at the start of the next billing cycle.
15. Suspension and termination
We may suspend or terminate your access to our services or subscription if you breach these Terms, engage in fraudulent activity, or misuse the service. You may stop using our services and cancel your subscription at any time as described in Section 14. Upon termination, you will not be entitled to a refund for any remaining subscription period, except as required by law.
16. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and notify active subscribers via email where appropriate. If you continue to use our services after updated Terms take effect, you are deemed to have accepted the revised version. If you do not agree to the changes, you may cancel your subscription as described in Section 14.
17. Governing law and disputes
These Terms are governed by the laws of Bulgaria, including the Consumer Protection Act and applicable EU consumer protection directives. Any disputes will be submitted to the competent courts in Sofia, Bulgaria. As a consumer, you also have the right to submit complaints to the Consumer Protection Commission of Bulgaria. If you have concerns, we encourage you to contact us first at contact@nutreal.bg so we can try to resolve the issue amicably. 17.1 Online dispute resolution As a consumer, you have the right to use the European Commission's online dispute resolution platform: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=BG Language In the event of any inconsistency between the Bulgarian version of these Terms and this English translation, the Bulgarian version will prevail.
